Support for Applicants Domiciled in the United States
We support you each step: from search to registration
Clearance search
We use a third party service to search the USPTO register and common-law sources for conflicts, then report to you in writing the results.
Filing strategy
We work with you to choose the filing basis and classes and draft the goods and services.
Application filed
We file with the USPTO and send you the filing receipt and serial number.
Examination
An examining attorney reviews the application. If there are objections, we report them to you and draft the response.
Publication and registration
The mark is published so others can oppose it. If no one does, a use-based application registers. If you filed on intent to use, you file proof of use first.

Filing from the European Union
Claim your earlier filing date
If you filed at the EUIPO or a national office in the last six months, the Paris Convention lets you claim that date for your US application.
Keep your address out of public records
The USPTO requires your domicile address. In most cases it can be hidden from the public record when you give a separate mailing address.
Pick the right route
You can file directly at the USPTO or extend an international registration to the US under the Madrid Protocol. We compare both for your budget and timeline.
An EU trademark does not cover the US. A US registration is a separate right
-
Your UK and EU marks stay separate
Since Brexit, a UK registration and an EU registration are separate rights. Neither covers the US.
Use matters more in the US
A UK registration can be granted without use. A US registration normally needs use in US commerce. Some routes let you file first and prove use later, and we choose the one that fits your launch plans.
Madrid from the UK
If you hold a UK application or registration, you can designate the US through the Madrid Protocol. We handle the US side, including any office action.
You do not need a US address or entity. You need a US-licensed attorney of record.
-
Use your home registration
If your mark is registered at home, you may be able to file in the US on that registration (Section 44(e)) without showing US use first. Use is still needed later to keep the registration.
Spanish and Portuguese marks
The USPTO may translate foreign words into English when it compares marks (the doctrine of foreign equivalents). We check this before you file.
Working across time zones
Intake and updates in English and Spanish, with one named attorney on your file.
Trademark FAQs
Can I file for my trademark myself?
1
Applicants outside the US need a US attorney
Since August 2019, the USPTO requires trademark applicants and registrants domiciled outside the United States to be represented by an attorney licensed in a US state or territory. Filings made without one can be dismissed. Only a US-licensed attorney can represent you before the USPTO.
How do you determine pricing?
2
Flat Fees for Most Filings
We calculate fees based on the type of application or filing. Most filings are flat-fee based. USPTO fees are due separately and will be provided to you before we begin working together.
What is the differs between my home country and U.S. law?
3
Five things that may differ from your home country
1 - Use in commerce
US registration rests on use. You show real use of the mark in US commerce with a specimen such as a label, packaging or a web page where the goods can be bought.
2 - Goods and services wording
The USPTO examines descriptions closely. Wording accepted at the EUIPO or a national office can be refused as too broad or unclear. We draft from the USPTO ID Manual wherever we can.
3 - Fees per class
Government fees are charged for each class of goods or services, using the same Nice classification you already know.
4 - Office actions
Examiners often raise written objections. The response deadline is short, usually three months, and a strong reply needs US legal arguments. We prepare it.
5 - Maintenance
US registrations are required to file a declaration of use between years 5 and 6, and renewal every 10 years.
